1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Form Fuse, a product provided by Skybin Technology Private Limited ("Skybin," "we," "us," or "our"). By accessing or using Form Fuse, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use Form Fuse. We reserve the right to update and change these Terms at any time without notice. Continued use of the service after any such changes constitutes your consent to such changes.

2. Description of Service

Form Fuse is a form backend service that:

• Receives and stores form submissions from your websites or applications
• Provides a dashboard for browsing, searching, and exporting submissions
• Sends instant notifications via email, Slack, Discord, or webhooks
• Applies built-in spam filtering to keep bot submissions out of your inbox
• Provides unique form endpoints that work with any HTML form

3. Account Registration and Security

3.1 Account Creation

To use Form Fuse, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

• Use a strong password and keep it confidential
• Notify us immediately of any unauthorized access or security breach
• Not share your account with others
• Not use another person's account without permission

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem appropriate.

4. Acceptable Use Policy

You agree not to use Form Fuse to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Collect or harvest information about other users without consent
• Use the service for any illegal, fraudulent, or malicious purposes
• Process personal data in violation of applicable privacy laws
• Submit false, misleading, or deceptive submissions to test the AI
• Reverse engineer, decompile, or attempt to extract our AI models
• Resell or redistribute the service without authorization

5. Subscription Plans and Pricing

5.1 Plans

Form Fuse offers multiple subscription plans with different features and submission limits. Current plans include Free, Pro, and Agency tiers. Plan details, features, and pricing are available on our website.

5.2 Billing

Paid plans are billed monthly or annually in advance. You authorize us to charge your payment method on a recurring basis. Fees are non-refundable except as required by law.

5.3 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle.

5.4 Price Changes

We reserve the right to change our pricing at any time. Price changes for existing customers will be communicated at least 30 days in advance and will take effect at your next billing cycle.

5.5 AppSumo Early Customer Plan

Form Fuse offers a limited early-customer deal exclusively through AppSumo: a one-time payment of $59 USD for 3 years of Pro plan access. The following terms apply specifically to this deal:

• Eligibility: This deal is available only to customers who purchase during the designated AppSumo campaign window. It is not available through any other channel.
• Included features: AppSumo customers receive all features of the Pro plan as it exists at the time of purchase. Future Pro features may or may not be included at Skybin's discretion.
• Term: Access is granted for 3 years from the date of purchase. After the term expires, the account reverts to the Free plan automatically.
• Renewal: AppSumo customers may renew at the then-current Pro plan market price. No locked, early-bird, or discounted renewal rate is guaranteed.
• Non-transferable: The AppSumo deal is valid for a single Form Fuse account and may not be transferred, resold, or shared.
• Billing and refunds: AppSumo acts as the Merchant of Record for these purchases. All billing inquiries and refund requests must be directed to AppSumo. Our standard refund policy does not apply to AppSumo purchases; AppSumo's own buyer protection terms govern instead (14-day refund window).
• Termination: Skybin reserves the right to close the AppSumo campaign at any time without prior notice. Existing AppSumo customers are not affected by campaign closure.
• Service modifications: Skybin reserves the right to modify, limit, or discontinue any feature of the Pro plan. AppSumo customers are subject to the same feature changes as regular Pro subscribers.

6. Data and Privacy

6.1 Your Data

You retain all rights to the form submission data you collect through Form Fuse. We process this data solely to provide our service as described in our Privacy Policy.

6.2 Data Responsibility

You are responsible for:

• Obtaining necessary consents from form submitters
• Complying with applicable data protection laws (GDPR, CCPA, etc.)
• Providing appropriate privacy notices on your forms
• Processing form data lawfully and ethically

6.3 AI Training

We may use aggregated, anonymized submission data to train and improve our AI models. We do not use personally identifiable information for this purpose without your explicit consent.

7. Service Level and Availability

While we strive to provide reliable service, we do not guarantee that Form Fuse will be available 100% of the time. The service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Technical issues beyond our control
• Events of force majeure

We are not liable for any damages resulting from service interruptions or unavailability.

8. Spam Filtering Accuracy

Our spam filtering system is designed to keep bot and low-quality submissions out of your inbox. However, no automated system is perfect. We do not guarantee 100% accuracy and are not liable for:

• False positives (legitimate submissions flagged as spam)
• False negatives (spam submissions that pass through filtering)
• Lost business opportunities due to filtering errors
• Any damages resulting from filtering decisions

9. Intellectual Property

9.1 Our IP

Form Fuse, including its software, AI models, design, trademarks, and all related intellectual property, are owned by Skybin Technology Private Limited. "Skybin" is a registered trademark. You may not copy, modify, distribute, or create derivative works based on our intellectual property.

9.2 Your IP

You retain all rights to your form data and any content you submit through Form Fuse. By using our service, you grant us a limited license to process, store, and analyze this data solely to provide our service.

10. Limitation of Liability

To the maximum extent permitted by law, Skybin Technology Private Limited shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or unavailability
• Third-party content or actions
• Unauthorized access to your data

Our total liability for any claims arising from your use of Form Fuse shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Skybin Technology Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Form Fuse
• Your violation of these Terms
• Your violation of applicable laws or third-party rights
• Your form data or submission content

12. Third-Party Services

Form Fuse integrates with third-party services like Slack, Discord, and custom webhooks. Your use of these integrations is subject to the terms and policies of those third-party providers. We are not responsible for the actions or policies of third-party services.

13. Termination

You may terminate your account at any time through your account settings. Upon termination:

• Your access to Form Fuse will be immediately revoked
• Your data will be deleted within 30 days unless otherwise required by law
• No refunds will be provided for prepaid periods
• Outstanding payment obligations remain due

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Form Fuse shall be subject to the exclusive jurisdiction of the courts in [City], India.

Before filing any legal action, you agree to attempt to resolve disputes through good faith negotiation with us.

15. Modifications to Terms

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
